It is outrageous that a Democratic party candidate compares Tea Party conservatives to thugs and rapists in her multi-million dollar ad campaign to buy a State Senate Seat. Even more outrageous is the new revelation that this candidate protected accused rapists at trial, said Eugene Delgaudio, of Sterling District.

The following information about Jennifer Wexton's lenient treatment of aggravated rape and abduction cases should be read by every voter in the 33rd District. I was appointed cheif of the Pentagon's Criminal Law Division principally because of my zealous prosecution of rape and child abuse cases. Based on my review of hundreds of cases involving violence against women, Jennifer Wexton has trivialized the seriousness of these heinous crimes.

The case involving Samuel Flores, who was alleged to have beaten and raped a woman four times in the course of a day is particularly disturbing. Wexton dropped this case down to a single count of misdemeanor sexual battery and released Flores for time served (less than two months). I am appalled by Jennifer Wexton's failure as a prosecutor. Uses Rape Case to Score Political Points in TV Ad
Yet Soft-on-Crime Prosecutor Went Easy on Four Accused Rapists
Candidate Runs a Dishonest Campaign to Hide a Shameful Record

LEESBURG, Va. - The Whitbeck for Senate campaign Monday called attention to Jennifer Wexton's disturbing prosecutorial record. Wexton released a TV ad last week that touted her prosecution of a rape case and compared her political opponents to rapists.

But in at least four cases - including one cited in her first television ad and two involving undocumented immigrants - Wexton went easy on accused rapists by reducing and dropping their charges, leading to light sentences that made a mockery of justice and undoubtedly put more women at risk.

"Jennifer Wexton's record calls her entire candidacy into question," Whitbeck spokeswoman Kristen Kalina said. "She claims to be a tough prosecutor, but in fact she was a classic soft-on-crime liberal who put our families at risk. She claims to be a fighter for women, but in fact she allowed several rapists to get off easy for heinous crimes. The fact is that Wexton is not being honest with voters about her record or any other candidate's record, because she knows the facts disqualify her from public office."

Wexton has made her experience as a prosecutor the centerpiece of her campaign and has said she will fight just as hard for Senate District 33 as she did for female rape victims. If that's her intention, Northern Virginia voters should think twice before sending her to Richmond.

Wexton's Shameful Record

2004: Loudoun Circuit Course Case Number 14750 (mugshot available upon request)

Travis Crosby allegedly breaks into a Cascades Commons apartment and rapes a woman at 2:30am. He is charged with rape, breaking and entering, destruction of property, assault, and abduction with intent to defile.

  • Wexton enters plea deal dropping the abduction with intent to defile charge, leading to a sentences that allows Crosby to be released next year.
  • This is the case Wexton shamefully exploits in her first TV ad


2001:
Loudoun Juvenile Court: JA009201, (01-05)
Undocumented immigrant Samuel Flores allegedly abducts a woman, then beats and rapes her 4 times over the course of day. He is charged with 4 counts of rape and one count of abduction with intent to defile.

  • Wexton drops 3 counts of rape and one count of abduction, and reduces one count of rape to misdemeanor sexual battery.
  • Flores is sentenced to time served (less than 2 months)

2001: Loudoun County General District Court, Case ID: GC01002309-00
Undocumented immigrant Walter Hernandez allegedly takes a woman into the woods and rapes her. He is charged with rape and abduction.

  • Wexton drops the abduction charge and reduces the rape charge to misdemeanor sexual battery
  • Hernandez is sentenced to time served (about 4 months)

2001: Loudoun Circuit Court Case 14025
David Antonio Moya-Guillen allegedly punches a woman in the face as she leaves work, then abducts and rapes her. He is charged with rape and abduction with intent to file.

  • Wexton drops the abduction charge and reduces the rape charge to battery
  • Moya-Guillen is sentenced to time served (4 months)
